BENEFITS FOR SOME BATTERED NONCITIZENS
To qualify for extensive benefit programs:
- Full Scope / Regular Medi-Cal
- CalWORKs
- Food Stamps
- County Medical Services (CMS)
- Healthy Families (children)
- General Relief
Need to look at:
- Immigration Documents
- Benefit Program Requirements that apply to all applicants
- Additional Requirements apply when applicant is battered
BENEFITS INTENDED TO COVER IMMIGRANTS THROUGH ENTIRE IMMIGRATION PROCESS
As petitions, visas and applications are renewed or approve, victims of domestic violence still qualify for certain public benefits.
Example:
1. Victim presents Aproved I-130, filed by spouse, and evidence of abuse
- Victim is given benefits through PRUCOL
- Victim is given letter by HHSA to take to Social Security so she can request a SS# for benefits
2. Victim presents I-360
Prima Facie Notice
- Victim continues to receive benefits through PRUCOL or "Qualified" Immigrant
3. Victim presents I-360
Prima Facie Extension
- Victim continues to receive benefits through PRUCOL or "Qualified" Immigrant
4. Victim presents I-360 Approval Notice &
Deferred Action
- Victim continues to receive benefits through PRUCOL or "Qualified" Immigrant
5. Victim presents renewed Deferred Action notice
- Victim continues to receive benefits through PRUCOL or "Qualified" Immigrant
6. Victim presents LPR Card or Stamp on I-551, I-94, or passport with code for battered spouse or child (e.g. IR1, B-26)
- Victim continues to receive benefits through PRUCOL or "Qualified" Immigrant
7. Victim presents Naturalization Certificate
- Victim continues to receive benefits as U.S. Citizen
BENEFIT REQUIREMENTS THAT APPLY TO ALL APPLICANT
- Applicant meets Income Guidelines AND
- Applicant is Parent (children under 21 and living with Applicant) OR
- Applicant is Relative Caring for Children OR
- Applicant is Child Under 21 OR
- Applicant is Senior over 65 OR
- Applicant is a Person with Disability
